Here’s the official summary of Oregon’s ADU bill, SB391:

Authorizes county to allow owner of lot or parcel within rural residential zone to construct one accessory dwelling unit on lot or parcel, subject to certain restrictions. Specifies that single-family dwelling and accessory dwelling on same lot or parcel are considered single unit for purposes of calculating exemptions from ground water rights requirements. Declares emergency, effective on passage.

Oregon’s ADU bill, SB391, would allow owners of at least two acres size in an area zoned “rural residential” to build an ADU on that land — provided there is currently a single-family dwelling there. Other restrictions stipulate that the ADU could not be larger than 900 square feet in usable area and must be built no farther than 100 feet from the existing home. You can see the entire bill by clicking here.

The summary indicates that this ADU bill will become law as soon as it is signed by the governor. Currently, it is awaiting a signature by the President of the Oregon Senate, Peter Courtney of Salem (status as of June 13, 2021).

(UPDATE: SB391 was approved by the Oregon State Senate and became effective on June 23, 2021.)

Chief sponsors of the bill are Oregon State Senators Dembrow, Findley, and Knopp.

Of the 30 Oregon state senators, three oppose the bill in its current form: Senators Boquist, Heard, and Robinson.

Each of the Senators primarily supporting and opposing the bill, along with the Senate president and the Oregon state governor, are listed above.
